they definitely feel like the most troubling aspects and the most troubling devices they found in james holmes' apartment have been diffused and they want to remove those devices and take them to secure locations so if there need to be other det nations and taken apart and dismantled they can do that in more secure environments instead of this apartment. now what happens is the collection of evidence. authorities here want to go through his belongings and his computers and that sort of thing trying to find any kind of evidence that would help him explain how he prepared and what led to this massacre in aurora, colorado, so all of that work continues. we're seeing the local firefighters that were here starting to clean up the hoses that were brought in as a precaution, but all of the investigators and bomb technicians are still here. they say there still is several more hours of work to do inside that apartment and the material that they want to get out. they also want to begin assessing just exactly what james holmes put in there. they weren't exactly sure what kind of materials he had been us
colleagues have spoken to the woman that lives just below james holmes and is obviously one of the people that had been evacuated. she explained to us the night of the shooting that there was loud music emerging from james holmes apartment and that she had gone up there to knock on the door and at one point had called authorities to let them know about that, but they said they were too busy with the shooting and they couldn't spare someone to come over here and do that, but she said the door was unlocked and told us the door was unlocked. obviously, she's very emotional about the fact she easily could have opened up that door and who knows what would have happened if she had done that. so luckily, for her, she decided not to do that and went back downstairs, but a lot of this area remains cordoned off and remains shut down. at one point, it would allow authorities to come back and james holmes' apartment, that will be shut down for quite some time and i'm not sure whether the surrounding areas will be opened up here in the coming days. obviously, the people whoive around this area are pro
theater. now we only have sketches of james holmes the 24 kraoerld suspect becaus24-year-old suspect because the court banned cameras after the defendant objected to them. he has been charged with 116 counts of attempted murder and murder. witnesses say holmes appeared just as dazed, actually no we heard different reports on this. this script says he appeared just as dazed as he did the first time. earlier i read from our fox news producer he appeared less dazed, less of the eye wandering and so on we saw the first time around. he's been sitting at counsel table, and tkae actually heard the charges against him. the former university of colorado student had apparently been under the care of a psychiatrist, and here is a picture of that doctor, lynne fenton happens to be a member of the university of colorado's threat assessment team. they are the ones in the wake of tragedies like at virginia tech assess the threat on campus and she counselors students and specializes in schizophrenia, and she was seeing james holmes as her patient. coming up we'll have a live report from the courtroo
family members and old friends of james holmes. he was a gifted kid, a student at the university of colorado, a phz. contradict that with this story that we have for you, it was the mere sound of his voice that led a gun club owner that we just spoke to to warn his employees about this 24-year- old. back on june 25, james holmes e- mailed an online application to a private gun club outside of denver in which he said he's not a drug user or a convicted felon. the owner called holmes three times to discuss his application. holmes never called back. our andean mccarren is in colorado. the message was very disturbing describing the voice as low, guttural, freakish even. he immediately told his staffers to not let holmes in to a july 1 orientation. >> one of my staff members called and said hey, what was the name of that person that you flagged for us? once that james holmes? i said yes. they said well, that's the name of the shooter. my main reaction was thank you, lord, for not giving him to us so we didn't have to have that problem. >> we also learned holmes purchased $300 worth of

. it will be a little longer than the first time that we had a court appearance by james holmes. tell us a little bit some of the other hearing matters that could come up. >> reporter: yes. judge william sylvester also has to make some ruling on a couple more motions. one is a motion by the defense regarding a package it said that in court documents that james holmes sent to his psychiatrist, dr. lynn fenton. the defense argued this package contained privileged information between patient and doctor and wants it turned over immediately. it accused the government leaking manufacturing to the media. 20 media organizations including fox news have a motion with the judge as well there is to unseal certain document in the case and the publics that legitimate interest knowing what action taken by a number of officials in the case. things get underway in the arapahoe court in a few minutes. back to you guys. jenna: alicia, thank you. rick: on to politics now and governor mitt romney wrapping up his high-profile three-nation tour in poland today. the republican presidential candidate is spending the last 36

in the colorado massacre returned to court today to face charges including first-degree murder. james holmes is the graduate student who is accused of killing 12 people and wounding 38 others. the hearing for holmes wrapped up in the last half hour. i want to bring in ed lavandara who is joining us from centennial, colorado. ed, walk us through the charges that he is faced with. >> sure thing, suzanne. essentially, james hmes has been charged with 142 criminal counts. 24 counts of first-degree murder and 116 counts of attempted murder, and essentially, that is doubled up on the number of victims inside of that movie theater. remember, 12 people killed an 58 people who were wound and taken to hospitals. now the legal reason behind that according to the paperwork we have received is that they were able to file double the charges on each of those victims, because number one, prosecutors say it was a planned attack, and premeditated and also because james holmes showed an extreme indifference towards the people he was killing, and that is that he did not matter who he was killing, but shooting i

-year-old james holmes was arrested at the scene without resisting. he lives in aurora. investigators are searching his apartment at this hour, looking for explosives because he told them that he might have explosives in his home and his car. police are expected to hold a news conference a little later this morning. but so far, aurora's police chief says there is no evidence of any additional shooters, and the fbi says there's no indication the incident is tied to any terrorist organization. >> we've talked to a lot of witnesses this morning who have designed an absolutely terrifying scene. a man who was at the front right of the theater came in right near the right-hand part of the screen, fired something into the air, and then opened fire on the crowd. according to investigators and our own pete williams, he was heavily armed with at least four weapons on him in addition to the tear gas, he was wearing a gas mask, dressed in all black and appeared to have a bulletproof vest. >> a lot of questions because according to just about every eyewitness, he came in through an emergency exit.

good-byes. as colorado shooting suspect james holmes sits in solitary confinement this morning, relatives of those killed in last friday's theater massacre have begun the grim task of planning their funerals with the first one being held today. nbc's jay gray reports from aurora. >> reporter: the focus on aurora today turned back to the suspect's apartment. prosecutors in james holmes' state appointed defenders getting their first look inside while back at the crime scene, a chain link fence went up around the theater, evidence teams continuing their search. as more seek for comfort in the wake of the tragedy. >> it's just a feeling of sadness and such loss. such loss for all the families. >> reporter: families like the teaves. >> he was probably one of the best sons any man could ever have, and i've been honored to know him. >> reporter: when the shooting started, 24-year-old alex teaves threw his mom and girlfriend to the door and died taking the bullets. >> got sent me an angel not just that night, but for three and a half years. he sent me an angel. >> reporter: emotions co

had is james holmes, born december 13th, 1987. he had an address in aurora, colorado. that's the address of the apartment that you looked at just a moment ago where jace larson was reporting from. matt, to answer your question, authorities say they did not find any explosives in that car. he claimed there were explosives in the car. there weren't any. he came to the scene with apparently four weapons. we're told it was a rifle, now a shotgun they say was the other long gun. and two pistols. the rifle was said to be a semiautomatic ak type. so that's capable of carrying a large magazine, a large number of rounds in the weapon before you would have to reload. i don't know what the two hand guns were. so they're now at his apartment in aurora and as you saw earlier they're doing this very carefully. we saw an officer standing on top of an evidence response van so that he could look into the window of the apartment and get a good look at it. that's the picture we're looking at earlier. this is a much earlier picture than we had a moment ago. >> right. >> you saw them with a han
